DO I HAVE TO FILE ANYTHING TO VACATE A JUDGEMENT?
I filed for bankruptcy in 2000 and according to my credit report it will be off in 2010. I included an eviction judgment on the bankruptcy and it is still being reported to potential landlords. Can I do anything about this and will it be off next year?
If the judgment was included in the bankruptcy, that means you don’t have to pay it. It doesn’t mean it never happened. It will continue to be reported.
“Vacating” a judgment is something the judge who issued the original judgment does when he changes his mind, usually due to new information like proof it wasn’t your debt.
