What exact forms do I need to provide the auto loan lender for banktuptcy?
I have an auto loan that the lendor wants to reposess, but Im filing bankruptcy and want to re-affirm the debt with them because its the only debt I want to keep because I want to keep the vehicle. I also have 6 other credit cards I want to file with. What exact forms do I need to provide the auto loan lender? Im doing the bk myself. What do I do when I call them? Do I tell them I’m filing? I’m in NH if that helps at all.
FYI-the tow truck was actually here this morning right after I wrote this. He sat out in front of my house-not in the driveway but on the road,for about 20mins then drove off, needless to say my garage door will stay shut!
I assume you are filing a ch 7 since you say you want to reaffirm the debt. In that case as soon as you get the bankruptcy filed and have a case number comtact them and give them that case number and the filing date. Be sure you keep making your payments to them every month. They will generally have a court approved reaffirmation agreement for you to sign which you will have to file with the court after it’s signed. If you are behind in your payments to the lendor after your case is discharged they have every right to immediately repossess it.
If I was wrong and you are wanting to do a Ch 13 bankruptcy stop immediately and find an attorney it’s too complicated to do without a law degree.
Also, do your filing as soon as possible because your lender can and probably will try to take the vehicle up until they have a valid case number. If they get it before your case is filed you may not be able to get it back.
