bankruptcy back child support
if a person files bankruptcy can they file their back child support that they owe under it?

My ex-husband owes back child support (alot) and when I filed for what he owed, the state increased the monthly payments and then he decided to file bankruptcy right after. I can’t find an answer to my question. Can he file what he owes under the bankruptcy and if so wouldn’t the bankruptcy pay on it or pay it off?

Child support and alimony and debts in the nature of support are not dischargeable in bankrupty. See Section 523(a)(5) and 523(a)(18) of the Bankruptcy Code.

However, you can file a Chapter 13 bankruptcy to pay off the back support over time if you have enough income.
