I assume you are asking about a Chapter 7.

I am an attorney and I have been involved with roughly 6,000 cases. How much an attorney can charge differs from state to state and district to district. Some states just let the market dictate what is fair.

I normally charge about 2% of the unsecured debt, with a minimum fee of $900. My clients can pay half of the fee up front, and the other half when we go to court. Also, make sure you ask about the Court’s filing fee.

The fee still differs a little from case to case. After interviewing some clients with, say, $100,000 in debt, I know it will be a no-hassle case and I will charge the minimum.

I recommend you get a lawyer. If you file it yourself and get into a problem, it will cost you 2 to 3 times as much in attorney fees because he will have to spend a lot of time cleaning-up the legal mess.

Here’s how you get a lawyer…If you know any attorneys, ask them if they can recommend a good bankruptcy attorney. You can also call the Bankruptcy Court’s Clerk’s Office (look under Federal Courts in your phonebook) and ask them if they know some decent Debtor’s attorneys. You could also call the U.S. Trustee or the Chapter 13 Trustee.

You should be wary of picking an attorney out of the yellow pages. While most really good attorneys do advertise in the yellow pages, the same is true for most really bad attorneys. If you are in a metropolitan area, DO NOT even consider a yellow pages ad that describes the firm as the largest bankruptcy filer in the area, state or whatever. Usually these firms (or bankruptcy mills) will treat you like a product on an assembly line and you may only get 15 minutes of time with an attorney.

An attorney who files between 150 to 400 cases per year should be about right. That means they have enough experience and business to do it full time and they can handle your case personally.
