Mortgage cram down in rental properties?
I relocate to a different city and is renting. The house which I was previously living has upside down mortgage.
If I rent it out, will it be considered as rental property and be eligible for a reduction on the mortgage principle by the judge if I file for bankruptcy?
If you rent it out it is income property. There will be no principle reduction, as it is an investment. The judge will require that you sell it, you will not be allowed to retain assets.
