Need help on the best way to go on land I’m foreclosing on?
We are foreclosing on raw land They have filed for bankrupty My attorney wants to file a ‘relief of stay’ However they have listed the engineer in the bankruptcy papers I ‘m thinking of letting the court give them 90 days to list,and try and sell this land I well contact the engineer to see what has been done and completed, to aid in the sale If they can sell it in this Calif. market fine if not I’ll be in a better position when I do list this land and save the cost of filing the ‘relief of stay’ aside from my spelling am I on the right track?To date they are 13 months past due
No except the down payment But I’m in 1st position They have pulled a 2nd and 3nd and stiffed others who have done work on this land I don’t care about the leaders They toke a chance and lost But I’ve pulled out of business and sold my apts in Calif you would think after 13 mos the courts there in Cal would do something But if your a apt.or business owner in Calif run for the hills Thanks
For several years, on the side, apart from my job, I was a real estate investor, in Texas. I do not know the r.e. laws in Calif., but suspect that the laws there are drawn up to favor the payer.
GET the Relief of Stay, and be quick about it.
Personally, after 60 days, and I receive an ‘eviction notice’, and after that, in Texas, there is another 30 days before move out.
For those of you in r.e. with out a lot of experience, find the ‘MEANEST REAL ESTATE LAWYER, and have him / her handle your r.e. problems. In time you will obtain enough knowledge to ‘wing it’ on your own. ALSO, do some study, at home on the real estate laws in your state.
The longer you hesitate, the bigger the problem becomes. Sounds mean and heartless, I know, but a bad r.e. situation is exactly like cancer, IT NEVER GETS BETTER ON IT’S OWN!!!
