I incurred some credit card debt while living in Utah that I can’t afford to pay now. I have tried to declare
bankruptcy twice since moving to Montana but because of ‘snafus’ neither one was ever filed. I was wondering how long the creditors have to sue me in the state of Utah before the statute of limitations expires. I was also wondering what if any difference it makes that I’m now living in Montana. Thanks.
Bankruptcy laws have changed. You can no longer use that to get out of paying credit card debt. Your best bet is to negotiate with the collector for a portion of the original debt. Insist that any negatives connected to the debt be removed from your credit report at all 3 agencies. They will tell you they can’t do that, but they can. Above all, get everything in writing before you agree to anything or make any payments. If it ‘s not in writing, they will most likely hold you to the original debt and continue to report you.
