bankruptcy spousal support
Can I put spousal support arrears in Bankruptcy?
Recently I fell behind in my Spousal support due to layoff… It went high into arrears and since then the Family Court judge put it in a Judgement status which means now its gaining interest at 9% annually. I have since gotten the spousal suport stopped but i owe more than 5k. Can i put it inot my bankruptcy if it is now in Money Judgement status. I am in NY State.
It is being paid on so im not worried about contempt but she lied to get it and the judge later found this out in open court and did nothing to her…
I feel for you.Once into that debt,Extremely hard to get out.In Cal it’s 10%.And by the way,not paying on it can get you a contempt of court charge which can be probation or jail.Good luck brother.
