getting a canadian tax refund after bankruptcy?
We got discharged 10 months ago. I contacted the canada revenue agency and they have us as being cleared for discharge on their end. We are slightly confused about this. We want to get our income tax done. The trustee said we can’t do cash back,but the tax consultants say we could. Even the canada revenue says we can. Has anyone had this happen and what happened? We could use our income tax for many things right now. We have no money owing to the trustee,but they aren’t dishcarged yet. UUGGGHHHH! such a pain!
Listen to CRA because that’s who you have to deal with. They may think when you say cash back, you mean you wonder if you can receive your refund this year and not have it go towards bankruptcy. By “cash back” I assume that you mean you want to get your refund on the spot when you get your taxes done. If you go somewhere like H&R (which you’ve already done?), they will be able to tell you whether you can do the cash back option. Even if they think they can and really they can’t, when they submit your claim electronically, CRA lets them know if there is any reason you don’t qualify. Worst case scenario is that they can’t submit it electronically and will have to send a paper return which can take 4 to 6 weeks to process. So, once you have all your paperwork together, don’t delay… just in case. I hope this helps a bit. =)
