If you file for chapter 7 and had a personal loan?

So, my father filed for chapter 7 about a year ago, this is in the state of Utah by the way. He had a personal loan of $10,000.00 through a Financial company, and used a vehicle that is now mine, that was once his, a 96 blazer, as Collateral, and included that loan in his bankruptcy. They never repossessed the vehicle, and the bankruptcy has been discharged. So I wanted to know, if it’s possible for them to still repress the vehicle, and if not, if it would be a good idea to go down there and get the title to the vehilce. Let me know, thanks.

It is hard to answer this question because it is unclear whether he had transferred the title to you before or after filing for bankruptcy. The vehicle that is now yours…. is the title in your name without his? Is there a leinholder listed on the title? If the original leinholder has been dismissed and the title is in your name, I’m pretty sure that the window of opportunity for a bank to ‘repress’ the vehicle has come and gone.

But of course, this is grossly unfair to the firm which financed the loan.
