Will I have to appear in court when I file bankruptcy?

I want to file for bankruptcy on my own without a lawyer. Besides filling out paperwork, do I need to appear in court? I see no other way than filing bankruptcy to get out of debt. Credit counseling is not helping and I want to start fresh. I have learned my lesson.

I am going to strongly advise you to have an attorney do your BK.

Since the law changed a few years ago, it became very difficult to understand all of the rules. Many attorneys that did BK’s occasionally stopped doing them because it got too complex, and the liability for a goofed up BK was on their shoulders.

If you file one wrong form, neglect to include something, miss a date, or do any of a thousand possible errors, your trustee is not going to have any sympathy for you.

Your case will be dismissed, and you will not be able to refile for 6 months. During that time period, your creditors are going to work very fast to get their judgments and recover whatever they can as fast as possible, before you can file again.

I know someone who had their BK dismissed, and the next day the car got picked up by a repo agency.

Don’t play around with this, please. Seek some legal advice.
