My company filed for chapter 7 bankruptcy?
I wasn’t paid my final paycheck. In what order are creditors paid and am I on the list.
Unpaid wages are an unsecured claim but they are a priority unsecured claim, meaning that they must be paid in full before any other unsecured claims are paid.
You do not need to go to the 341 Meeting to file a claim for unpaid wages. However you may need to file a claim. If you get a notice from the bankruptcy court, be sure to follow all the instructions, paying particular attention to deadlines, for filing a claim for your unpaid wages.
You may also want to look into filing a wage claim with your state’s department of labor. In some states, the department of labor will pay the unpaid wage claim and then recover it from the employer (or the employer’s bankruptcy estate).
