Need advice with legal help?
I’m in the process of bankruptcy. Even though Im separated I had to file jointly not having any stand alone debt. My question is she had secret account with a lover.He left her high and dry owing that bank (Chase). Collocation Agency could my folks house left their number. I could and find out his name and everything else.Now can I use that along with all the other unpaid bills in a custody case (Kids live with me now) when I can afford to file for divorce? Over the years I didn’t keep all the e-mails she had with some other guys or the chats with adult groups. I will be honest with you. I really want to stick to her and break it off.I’m really short on money and could use some free advice
Are you legally separated? You need to be and you need to have an agreement that as of “this date”, you are each responsible for your own bills. Otherwise, since you are still legally married, any debts she runs up will be half yours.
If the collection agency is coming after you, you are probably stuck since they don’t care who opened the account, but the bankruptcy should take care of that. You could try and sue them both in small claims court to get the money to pay it off, if you have enough evidence.
