Why did GMAC charge me $300 in fees after my bankruptcy?
I filed Chapter 13 bankruptcy in Nov 2008. I received my billing statement from GMAC mortgage for February 2009 and there was an additional $300 charge on my bill under “Other Fees and Charges”. I was told by GMAC when I called that they could not discuss these charges with me and I would need to call their attorney. I have called their attorney twice and email once, without any return calls or emails. Does anyone have any experience with GMAC like this and have gotten answers from them? Could these charges have anything to do with the fact that I filed Chapter 13? I feel these charges are unfair since my chapter 13 payment plan very clearly states that I will continue to my mortgage in accordance with the original mortgage contract. Who is right here? Please advise me.
Most likely they are correct. Seeing you filed bankruptcy, the fees are probably legal fees to have an attorney review your loan with them and your claim of filing for bankruptcy. Even though you agreed to continue to pay the loan as you did before, they still have to consult with someone legally that handles bankruptcies. So, they probably don’t need to give you an explaination, but, sounds to me like they had someone in legal consult your case. Good Luck!
