Can I have a savings account before my bankruptcy is discharged? Will the trustee take the money?
We filed chapter 13 in 2006. It will be over in 2 years. Can we have a large sum of money in a savings account? Will the trustee find out about the savings account?
Contact your bankruptcy attorney to find out if you are allowed to have any funds in a savings account, they are your attorney throughout your chapter 13 plan payments,(they are still getting paid thru your plan) and you want to make sure you don’t open a savings account and the courts attach that money to the debts you owe. Reason being, if you were to get someone to finance you for something you needed to have, ex: a new vehicle, even though you are in a chapter 13 plan, you still have to have the trustees approval. You want to make sure you do everything correctly so the trustee doesn’t dismiss the case for something that you were not aware of. Good Luck!
